Abstract

This research is motivated by the existence of a regulation, where in conducting traditional medicine must have a license to practice and cannot be done by just anyone, especially other than a doctor. The formulation of the problem to be discussed in this study is how the legal protection of consumers who have experienced the impact of traditional medicine and how the liability of business actors who are negligent in providing traditional medicine services. This type of research is a normative legal research that uses Legislation Approach, Conceptual Approach, Case Approach. The conclusion obtained is that if there is someone doing treatment but does not have a practice license then it is not allowed to do the treatment, where in this case to do treatment there must be a practice license from the district government or city government where medical personnel or health workers carry out their practice. Meanwhile, there are still around the community where treatment is carried out without a license to practice such as pharmacists, shamans and so on. This research is expected to increase insight and become a reference or reference for future research for the legal protection of consumers in the use of traditional medicine performed by other than doctors.
