Abstract

Conflicts in society often occur in social interactions, involve two or more parties, and can be in the form of civil disputes that are classified into disputes related to unlawful acts (onrechtmatige daad) and default (breach of promise). Disputes over unlawful acts arise from legal relationships born from the law, while disputes over default arise from agreements that arise from agreements. Decision No. 4/Pdt.G/2022/PN.Gsk is a series of civil case proceedings in the court of first instance, starting with a lawsuit for unlawful acts from the plaintiffs to the defendants and then the defendants file a reference lawsuit. The Panel of Judges of the Gresik District Court who examined and tried the case granted the lawsuit for reconvention of default in the case of acts against the law for part. The formulation of this research problem is to analyze the decision and explore the ratio decidendi of the panel of judges. Seeing the judge's consideration in deciding and resolving the case, the author is interested in conducting research, in this discussion the research method used is normative with a Legislative, Conceptual, and Case approach. In this discussion, it is a valid one and has a strong source of reference. The findings in this study are that in cases of unlawful acts, judges must carefully consider and differentiate between unlawful acts and defaults. In some cases, the judge may grant a default reconvention lawsuit if there is strong evidence that the defendant's actions are unlawful and not merely a default. The results of this research are expected to contribute to the development of civil law and justice that is fairer and more transparent in handling cases of unlawful acts and defaults. This study will analyze the judge's considerations in granting a default reconvention lawsuit in an unlawful act case, focusing on the decision of the Gresik District Court Number 4/Pdt.G/2022/PN Gresik.
