Abstract

More and more people are conducting online game buying and selling transactions due to advances in information and communication technology. Payment through joint account services is one of the most common payment methods. The purpose of this study is to evaluate the validity of a sale and purchase agreement made through a joint account service (escrow) in an online game transaction as well as the form of legal protection for buyers who are harmed by the service. Escrow mechanisms are often used in online gaming transactions to increase security and trust between sellers and buyers. However, in reality, these transactions often do not meet the legal requirements of an agreement as stipulated in Article 1320 of the Civil Code, especially in terms of the legal capacity of the parties. To provide better protection and legal validity for all parties involved, this research finds that there is a need for more specific legal adaptations to accommodate the unique features of online gaming transactions and the use of joint account services.
