Abstract

Food agricultural land is very important to support regional food supplies, but increasingly food agricultural land is starting to be shifted by the conversion of agricultural land to non-agricultural land. This is a problem in the food agriculture sector, where this problem has been felt in the Sidoarjo Regency area. The purpose of this writing is to understand the legal consequences of changing the function of agricultural land to industrial or residential land if viewed from Sidoarjo Regency regional regulations no. 6 of 2009 concerning Sidoarjo Regency Spatial Planning for 2009 – 2029. The type of research used is normative jurisprudence using a statutory approach and a conceptual approach. This research produces factors that cause agricultural land conversion activities. Next, this research explains the legal consequences if agricultural land conversion occurs in Sidoarjo Regency if viewed from Sidoarjo Regency regional regulation No. 6 of 2009 concerning Sidoarjo Regency Regional Spatial Planning Plan. This research concludes that there are several sanctions that can be applied if the transfer of land use is carried out illegally, these regulations are stated in articles 144-148 of Sidoarjo Regency regional regulation No. 6 of 2009 concerning the Sidoarjo Regency Regional Spatial Planning Plan, however land conversion can be carried out by complying with several requirements that have been set by the Sidoarjo Regency regional government. Furthermore, it is important for Sidoarjo Regency to have regional regulations regarding the protection of agricultural land and sustainable food in order to protect agricultural land and maintaining the existing food supply in the Sidoarjo Regency area
