Abstract

As trade through e-commerce continues to grow rapidly, social media also sees opportunities to gain profits by adding sales features to its applications. This phenomenon is known as social commerce (s-commerce), namely trading carried out through social media, where initially social media was only used as a means for communication and interaction between users, shifting to become a means for selling and promoting products, so that evolution and shift to social commerce. The problem currently being faced by MSMEs in Indonesia is business competition in s-commerce which not only disrupts the businesses of MSMEs, but beyond that, s-commerce has caused business failure for some small businesses. The issue of prices of goods, products and marketing is an obstacle that MSMEs must face continuously without any certainty of an end. The type of research used in this legal research is normative juridical research. Normative juridical research is a legal research method carried out by examining library materials or secondary materials which bases its analysis on applicable laws and regulations that are relevant to the legal issues that are the focus of the research. The research results show that the government has not regulated regulations related to restrictions on large business actors such as large producers/distributors/resellers from selling directly in s�commerce. With the calculation that the number of MSMEs in Indonesia in 2023 will be 64 million business units which are required to start adapting to s-commerce without ready capital, resources and appropriate guidance, then MSMEs will not be able to compete in the era of digital technology development in the future.
