Abstract

The Health Social Security Administering Agency (BPJS) is a legal entity that organizes social security programs to ensure that everyone can fulfill the basic needs of a decent life. The impact of the economic crisis that has occurred in Indonesia has so far spread to all areas of life, including the health service sector. The dilemma facing health services is that on the one hand they must fulfill their social mission, namely caring for and helping those who suffer regardless of social, economic, religious, political, etc. characteristics. For this reason, the government is considering removing the BPJS Health classification based on classes that have been in effect into one class known as the standard inpatient class (KRIS) or standard class. However, on the other hand, health services must be able to survive economically in the face of this crisis. Therefore, health services need to be reformed, reoriented and revitalized. From the various problems currently existing, what is the analysis regarding the abolition of standard classes at BPJS Hospitals and what are the government's recommendations regarding the abolition of standard classes? This research uses normative law (normative law research) or normative juridical research, namely research that establishes law as a system of norms. The norm system in question concerns principles, norms, rules, from statutory regulations, court decisions, agreements, comparative law, doctrine (teachings) and jurisprudence. This research aims to analyze the elimination of standard health service classes and to find out about recommendations for eliminating standard classes. Based on information from the Ministry of Health (Kemenkes), currently there are 728 hospitals that meet the criteria for 12 National Health Insurance Standard Inpatient Classes (KRIS JKN).
