Abstract

The abolition of ownership rights over land which is used as the object of collateral for Mortgage Rights will of course give rise to its own legal problems, because according to the provisions of Article 18 paragraph (1) letter d UUHT, Mortgage Rights are abolished due to the deletion of rights to land which is encumbered with Mortgage Rights. The elimination of mortgage rights that burden the land of ownership does not cancel the debt and receivable agreement between the creditor and the debtor. This situation will certainly be detrimental to the mortgage right holder if the debitor defaults because the credit provided does not receive specific legal protection but only general legal protection. . This research uses normative legal research methods by referring to various related legal regulations and literature studies. It is hoped that the results of this research will provide a better understanding of how the law regulates this situation and provide recommendations for improving or increasing legal protection for creditors in cases like this. From this understanding, what is the protection for creditors as holders of mortgage rights after the removal of ownership rights to the land used as collateral. Based on the results of the research and discussion, it can be seen that if the ownership rights to land which are used as collateral for mortgage rights are removed, the mortgage rights will also be erased. Efforts that creditors can take to pay off their receivables are giving permission to the debtor to take compensation for losses due to the loss of ownership rights to land which have been entrusted to the local district court, entering into an addendum to the credit agreement and changing the collateral which is then agreed upon by the debtor and the creditor, executing other assets. owned by the debtor. If these efforts do not reach an agreement, the creditor can file a lawsuit, namely through litigation, namely resolving the dispute through a court proceeding.
