Abstract

This study aims to examine the meaning of freedom of expression contained in Article 28E paragraph (3) of the 1945 Constitution of the Republic of Indonesia and its suitability for the limits of freedom of expression in Indonesia which is normatively regulated in Article 27 paragraph (3) of Law Number 19 of 2016. This type of research is normative legal research. The approach method used is a statutory approach and a conceptual approach. The legal materials used include primary, secondary and tertiary legal materials. The technique of collecting legal materials by searching for laws and regulations relevant to this legal issue with normative analysis techniques to produce prescriptive conclusions. The results of this study found that the meaning of freedom of speech according to Article 28E paragraph (3) of the 1945 Constitution is freedom of speech includes the ability of every individual to express their opinions, views, or ideas without fear of repression or punishment from certain parties, including the government or certain groups. It provides a platform for criticism of government policies or actions. As well as providing important insights to encourage positive change and improvement in society and also followed by responsibility. The limitation of freedom of expression in Article 27 paragraph (3) of the Law on the Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions is not in accordance with the meaning of freedom of expression contained in Article 28 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, because in Article 27 paragraph (3) of the ITE Law the meaning of insult or defamation is still vague and multi-interpreted so that it can be misused to limit the freedom of others.
