Abstract

YouTube content can be used as a livelihood so that someone who makes YouTube content their main source of income is usually known as a YouTuber (content creator). The emergence of YouTubers makes the virtual world increasingly exist, so this is what makes someone dive into the world of YouTube. This research aims to know and analyze the YouTube content can be used as a credit guarantee in bank based on Law Number 42 of 1999 on Fiduciary and to know and analyze the law of credit guarantee in bank using YouTube content. The type of research used is normative legal research, using the type of statute approach, and case approach. The legal materials used are primary legal materials, secondary legal materials, and tertiary legal materials with technique of library research and deductive method. The result show that copyright as an intangible movable objects according to legally valid as a fiduciary guarantee if the copyright has been registered at the Fiduciary Registration Office, certified for Intellectual Property Rights (HAKI) from Ministry of Law and Human Rights by the fiduciary recipient, 5C, 7P, and 3R principles of providing bank credit to customers have been fulfilled and also the existence of an assessment agency (appraisal) who is tasked with assessing the intellectual property of YouTube content. On sharia financing, there are additional analysis, it names sharia analysis. Furthermore, with the ratification of Government Regulation of the Republic of Indonesia Number 24 of 2022 concerning Implementing Regulations of Law Number 24 of 2019 concerning the Creative Economy, this Government Regulation regulates how to specifically regulate the economic rights of copyright holders. This government regulation also regulates financing schemes that can be proposed by the public using intellectual property as the warranty object.
