Abstract

Dalam penelitian ini, peneliti menggunakan judul “Sistem Pengupahan Perusahaan Padat Karya Basis Ekspor (Tinjauan Yuridis Permenaker Nomor 5 Tahun 2023)” dengan tujuan untuk mengetahui alasan dibalik penetapan peraturan yang memperbolehkan perusahaan tertentu untuk membayar upah pekerja di bawah ketentuan Undang-undang yakni Upah Minimum. Memakai metode penelitian normatif, yaitu meneliti peraturan perundang-undangan, pengertian hukum, ataupun doktrin hukum untuk digunakan dalam menjawab isu permasalahan dalam penulisan ini. Penelitian ini menggunakan pendekatan undang-undang, historis dan konseptual. Berdasarkan penelitian, upah ialah imbalan atau pembayaran yang menjadi hak pekerja/buruh dan sebuah kewajiban bagi perusahaan/pengusaha. Upah minimum telah ditetapkan dengan undang-undang yang mana menjadi patokan pengusaha dalam membayar pekerjanya. Namun dengan adanya fenomena perubahan atau krisis ekonomi global, didapati peraturan yang memperbolehkan perusahaan/pengusaha untuk membayar upah yang lebih rendah dari upah minimum. Lantas mengapa hal tersebut diperbolehkan, faktor apa saja yang membuat ditetapkannya peraturan tersebut. Sekaligus guna mengetahui apakah perlu peraturan seperti ini diberlakukan kembali pada fenomena sama yang akan terjadi di masa yang akan datang. Hasil penelitian menunjukkan bahwa ditetapkannya peraturan yang memperbolehkan membayar di bawah Upah Minimum tersebut adalah karena dampak dari pada perubahan ekonomi global dengan ditunjang oleh data yang menyatakan bahwa kegiatan ekspor pada perusahaan padat karya mengalami penurunan yang berkisar 4,15% dibanding bulan-bulan sebelumnya, yang mana akhirnya menjadi urgensi bagi Pemerintah untuk menanggulangi permasalahan tersebut. Serta perlunya peraturan serupa diberlakukan, dengan catatan-catatan tertentu dalam pembuatannya. Kata Kunci: upah; permenaker; pekerja
