Abstract

The implementation of Tuban Regency Regional Regulation Number 5 of 2018 regarding the Implementation of Education, has not provided sufficient space for the implementation of inclusive education, this is proven by the lack of support in the form of a Regent's Regulation as a technical regulation for the implementation of inclusive education in Tuban Regency. So the Tuban Regency Government has not been able to provide inclusive education properly because it is only accommodated in Regional Regulations. In fact, the regulatory nature is very important so that the implementation of inclusive education in Tuban Regency can be carried out well. This research presents two problem formulations, namely: 1. How is the Legal Protection of the Rights of Children with Special Needs in Inclusive Education, 2. How is the implementation of the regulation of the educational rights of children with disabilities from a Human Rights perspective in Tuban Regency Regional Regulation No. 5 of 2018 concerning the implementation of inclusive education. This type of research is normative research which uses a statutory approach, a conceptual approach, and a comparative approach. The conclusion obtained is that every child has the right to grow and develop without discrimination for the best interests of the child and to fulfill all their participation in planning and determining their future life. In order to implement inclusive education in Tuban Regency, a Regent's Regulation should be immediately issued to support the acceleration of the implementation of inclusive education. So that the Tuban Regency Government can ensure that every individual has easy and equal access to parties who need good inclusive education that reflects justice.
