Abstract
Indonesia is a constitutional state that adheres to a democratic system and has the responsibility to guarantee protection for every citizen, especially in terms of freedom of speech as stated in Article 28 E paragraph (3) of the 1945 Constitution. Indonesia adheres to the principle of separation of power placing the People's Representative Council as the highest state institution in the legislative field. The DPR in carrying out its duties and obligations is provided with an instrument of immunity (right of immunity). The right to immunity is contained in Article 20 A paragraph 3 of the 1945 Constitution and Law Number 2 of 2018 concerning the MPR, DPR, DPD, DPRD (MD3). This study aims to determine and explain the position of the right of immunity in the perspective of a rule of law. The approach method used is the statutory approach (statue approach), conceptual approach (conceptual approach) and comparative approach (comparative approach). If examined in the perspective of a rule of law that is not only limited to laws, the right to immunity is given in order to protect the attitudes, actions and opinions of members of the DPR RI so that they are not easily criminalized in carrying out tasks assigned by the state although sometimes the right of immunity is used as a shield by members of the DPR RI in the event of a lawsuit. Apart from that, a new problem has emerged in Article 245 paragraph 1 of Law No. 2 of 2018 concerning MD3 which is considered a conception of expanding immunity rights for members of the DPR. Members of the DPR are considered to have taken refuge behind the authority of their ethical institution, namely the Honorary Council of the Council.
