Abstract

In today's era, buying and selling through e-commerce is a common activity. E�commerce providers make sales and purchase agreements with electronic contracts or commonly known as standard clauses, standard clauses are any rules or conditions and conditions that have been prepared and determined in advance unilaterally by business actors as outlined in a document and / or agreement that is binding and must be fulfilled by consumers, the problems described in this Normative Research aim to find out the form of good faith in the clause default, especially on e-commerce which is reviewed from Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Online. Peraturan Pemerintah Republik Indonesia Nomor 71 Tahun 2019 Tentang Penyelenggara Sistem dan Transaksi Elektronik and this study also aims to determine the legal consequences if there is no good faith principle in the standard clauses in e-commerce, especially on the E�Commerce, the legal consequences of the absence of good faith in the online sale and purchase agreement can result in civil prosecution of the party with bad faith.
