Abstract

Penyelenggaraan pemilihan umum adalah bentuk wujud dari sistem demokrasi yang dianut terhadap setiap negara yang menerapkan nilai-nilai demokratis. Pelaksanaan pemilu bukan hanya dijadikan suatu bentuk kebutuhan untuk kekuasaan pemerintah dalam menjalankan masa kepemimpinan, melainkan agar dijadikan sebagai sarana prasarana untuk rakyat mengartikulasikan aspirasi dan kepentingan di dalam kehidupan bersama. Rakyat juga dapat memilih para wakil mereka yang nantinya akan menduduki kursi saat di parlemen sebagai anggota di legislatif. Landasan hukum penyelenggaraan pemilu legislatif di Indonesia terus mengalami perubahan sejak era reformasi dimulai. Perubahan undang-undang pemilu selalu dilakukan sebelum pemilu diselenggarakan, berdasarkan penilaian hasil pemilu sebelumnya karena alasan lain. Perubahan ini tentu saja berbarengan dengan revisi undang-undang penyelenggara pemilu dan undang-undang partai politik. Paket reformasi hukum ini tentunya juga dikenal sebagai paket reformasi hukum utama. Kesenjangan peraturan perundang-undangan juga dapat menimbulkan perbedaan interpretasi terhadap pelaksanaan peraturan tertentu. Putusan Mahkamah Konstitusi yang menghapuskan sistem pemilu yang membatasi penghitungan suara menunjukkan tidak memadainya aturan pemilu tersebut.
