Abstract
The research with the title "Legal Protection of Non-Procedural Indonesian Migrant Workers" aims to 1) analyze the obligations of the State in providing legal protection to Non-Procedural Indonesian Migrant Workers. 2) analyze the form of legal protection for Non-Procedural Indonesian Migrant Workers. This research is normative legal research, the approach used in this research consists of the Statute Approach and Conceptual Approach. Types and Sources of Legal Materials used are primary legal materials, secondary legal materials and non-legal materials. The results of this study are 1) The state is obliged to provide legal protection to non-procedural Indonesian migrant workers based on universal human rights principles that recognize and protect the basic rights of every individual, regardless of their migration status. In addition, there are human rights inherent in non�procedural Indonesian migrant workers that are also regulated in national (1945 Constitution and Law No. 39 of 1999 on Human Rights) and international (Universal Declaration of Human Rights, International Covenant on Economic, Social and Cultural Rights and International Covenant on Civil and Political Rights) human rights legal instruments. 2) In general, the form of legal protection against non�procedural migrant workers is divided into two, namely Preventive Legal Protection consisting of Prevention of non-procedural migrant workers and checking the completeness of files, then Repressive Legal Protection consists of Citizen Lawsuits, Pre-deportation and Repatriation of non-procedural migrant workers to the Region of Origin.
