Abstract

Tujuan dari penelitian adalah untuk mengetahui dan menjelaskan masa kerja bagi tenaga honorer yang berada pada satuan kerja perangkat daerah atau ASN. Penelitian ini merupakan penelitian hukum dengan mengkaji peraturan perundangan yang ada di Indonesia dengan berbahan hukum perundangan hingga literatur hukum seperti buku dan jurnal. Peraturan perundangan berkaitan dengan aturan tenaga honorer dan masa kerja. Hasil dari penelitian ini bahwa Satuan Kerja Perangkat Daerah merupakan bagian kerja yang memiliki ruang lingkup di dinas daerah, kecamatan hingga kelurahan/desa dimana tenaga honorer juga terdapat di dalamnya. Masa kerja terhitung saat pekerja memulai pekerjaannya hingga pekerja berhenti dari pekerjaan tersebut. Dalam pemerintahan, tenaga kerja pemerintah sangat memperhatikan Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara (UU ASN) menegaskan ketentuan Pasal 99 ayat (1) dan ayat (2) UU ASN menimbulkan tindakan diskriminasi serta hilangnya jaminan pemenuhan hak asasi manusia, sehingga bertentangan dengan Pasal 28I Ayat (2) dan Ayat (4) UUD 1945 dan harus dimaknai dengan pengecualian terhadap tenaga honorer atau sebutan lain sejenis serta PPPK yang berasal dari tenaga honorer.. Kesimpulan dari penelitian ini menemukan bahwa tenaga honorer cenderung memiliki masa kerja yang sedikitnya satu tahun dan dapat dilakukan secara terus-menerus. Dalam ruang lingkup satuan kerja perangkat daerah tidak mengacu pada aturan yang belaku. Tenaga honorer dalam satuan kerja perangkat daerah tidak atau belum diatir dalam hukum positif Indonesia sehingga merupakan kekosongan hukum.
