Abstract

Advertising is the most common means used by business actors in the service sector in marketing the goods they produce or the services they offer. The relationship between business actors and advertisers has a favorable legal relationship. based on agreement and the existence of a causal relationship between them. In this era of digitalization, when advertising a product, it is better known as an endorsement. Endorsement means support where the party carrying out the promotion is known as an influencer. Influencers are promotional service providers who have a role in assisting business actors to promote a product or service, the promotion is usually in the form of advertising as a promotional media for products that will be produced and will be sold to the public or consumers with the aim of obtaining profits that will be obtained by business actors. However, promotions that are carried out often provide excessive information to attract consumer interest, sometimes the information presented is unclear and not with facts. Cosmetics are currently an important item for both men and women. The widespread use of cosmetic products on the market is often used by business actors to market products that do not have a distribution permit for their personal interests. The position of Influencers has not been regulated by Indonesian Law. This situation affects the legal consequences that arise when influencers advertise cosmetic products that are detrimental to consumers because they do not have a distribution permit. In Indonesia, consumer interests in the use and use of products are protected by Law No. 8 of 1999 concerning Consumer Protection. The results of the discussion on the Position of Influencers in Cosmetics Endorsements as an Advertising Party. Even though there is no law that regulates for sure, in endorsement influencers must comply with the laws that apply to advertising. So it can be concluded that influencers can be responsible for their advertising if it is considered detrimental to consumers. Keywords: Endorsement, Influencers, Legal Protection
