Abstract
The purpose of writing legal research in fulfilling the requirements of my Bachelor of Law is to find out how Pertamini's consumer legal protection whose rights are not fulfilled due to losses in this buying and selling business activity. So that there is legal certainty for Pertamini consumers in their sale and purchase agreements. This thesis research is carried out by researching the type of normative legal research, then in its approach with a legal approach (statute approach) and conceptual approach (conceptual approach). Based on this research, it was concluded that Pertamini business owners must always be responsible for consumer losses. This is known as the Presumption of Always Being Responsible. Consumers can file a tort lawsuit if there is a previous agreement and can be an act against the law if there is no mutual agreement but consumers feel aggrieved. The fastest way to resolve this dispute is through non-litigation channels involving BPSK rather than litigation channels using the Court. There are three common options in settlement through non-litigation steps namely mediation, arbitration, and conciliation. The government's efforts to provide protection to consumers, the government has several agencies that have a role to protect consumers, these institutions or agencies are BPKN, LPKSM, YLKI, BPSK.
