Abstract

Skripsi ini bertujuan untuk mengetahui tanggung jawab rumah sakit atas tindakan penolakan yang dilakukan oleh tenaga kesehatan terhadap pasien tidak mampu dan perlindungan hukum terhadap pasien tidak mampu secara keperdataan atas tindakan penolakan yang dilakukan oleh tenaga kesehatan di rumah sakit. Penulisan hukum ini termasuk jenis penelitian hukum normatif yang bersifat preskriptif dengan menggunakan pendekatan perundang-undangan (statue approach) dan pendekatan konsep (conceptual approach). Sumber bahan hukum yang digunakan adalah bahan hukum primer dan sekunder dan tersier. Teknik pengumpulan data yang digunakan adalah studi kepustakaan atau studi dokumen, selanjutnya teknis analisis yang digunakan adalah metode normative preskriptif. Hasil penelitian dan pembahasan yang penulis lakukan didapatkan kesimpulan bahwa rumah sakit dibebankan tanggung jawab secara perdata atas tindakan kelalaian tenaga kesehatan di rumah sakit yang menolak pasien tidak mampu yang menyebabkan kerugian pada seseorang/pasien didasarkan pada Pasal 46 Undang-Undang Nomor 44 Tahun 2009 tentang Rumah Sakit, asas vicarious liability, dan doktrin respondeat superior. Wujud dari pertanggungjawaban perdata rumah sakit adalah mengganti kerugian yang diderita oleh pasien. Perlindungan hukum terhadap pasien tidak mampu secara keperdataan atas tindakan penolakan yang dilakukan oleh tenaga kesehatan di rumah sakit pada keadaan gawat darurat diatur di dalam KUHPerdata Pasal 1365, Pasal 1366, dan Pasal 1367. Perlindungan hukum yang diberikan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan selaku perangkat hukum di kesehatan diatur di dalam Pasal 58 yang pada intinya setiap orang berhak menuntut ganti rugi terhadap seseorang, tenaga kesehatan, dan/ atau penyelenggara kesehatan yang menimbulkan kerugian akibat kesalahan atau kelalaian dalam pelayanan kesehatan yang diterimanya.
