Abstract

Tujuan penelitian hukum ini adalah untuk mengetahui perlindungan hukum bagi dokter yang melakukan pelayanan telemedicine. Sehingga tercapai pelayanan kesehatan yang memadai dan berkeadilan. Penelitian dilakukan ini merupakan penelitian hukum normatif, dengan pendekatan undang-undang (statute approach) dan pendekatan konseptual (conceptual approach). Berdasarkan penelitian ini didapatkan kesimpulan bahwa Undang-Undang Nomor 36 Tahun 2009 Tentang Kesehatan dan Undang-Undang Nomor 29 Tahun 20004 Tentang Praktik Kedokteran melindungi dokter yang melakukan praktik secara umum, namun belum memberikan perlindungan hukum terhadap dokter yang melakukan pelayanan telemedicine sepenuhnya karena belum ada aturan penyelenggaraan telemedicine secara lengkap. Peraturan Menteri Kesehatan Nomor 20 Tahun 2019 Tentang Penyelenggaraan Pelayanan Telemedicine Antar Fasilitas Pelayanan Kesehatan, hanya mengatur tentang penyelenggaraan rujukan pasien antar fasilitas layanan kesehatan saja. Perlindungan hukum seharusnya dapat diberikan melalui Undang-Undang khusus tentang dokter yang melakukan pelayanan virtual jarak jauh (telemedicine) yang memuat kewenangan telemedicine sehingga terdapat kepastian hukum atas hak dokter yang dilindungi dalam melakukan pelayanan telemedicine.
