Abstract

The disparity of judges' decisions is considered a disturbing issue in the integrated criminal justice system and the practice of taku disparity is only found in Indonesia. Legal disparities are also often associated with the independence of judges. The sentencing model regulated in the invitation in the form of the formulation of maximum criminal sanctions also contributes to this practice. The disparity in judges' decisions on the same case against criminal acts committed by children still often occurs in court decisions, especially criminal acts of drug abuse. The purpose of this study is to determine the protection in the perspective of Human Rights in children against the disparity of criminal drug abuse convictions. The research method used is normative juridical using a statutory approach. Ideal juvenile criminal justice and sentencing guidelines provide human rights protection for children in conflict with the law. It is recognized to ensure the establishment of proportionate, predictable, one-way and efficient justice in the criminal justice system. Keywords: disparity of verdicts, criminal acts, drug abuse.
