Abstract

In Judgment Number: 867/Pid.B/2021/PN. Jkt.Sel The defendant on behalf of Fikri Ramadhan was convicted of the crime of murder, but on the basis of noodweer and noodweer exces The defendant was sentenced to escape all legal claims. The imposition of noodweer and noodweer exces conditions for the Defendants shows a vague side of the norm and there is a judge’s consideration of not paying attention to the facts therein. The formulation of the problem: 1. How the qualifications of noodweer and noodweer exces in criminal ’iability relate to the criminal act of murder; 2. How is the consideration of the Panel of Judges in the case with Decision Number: 867/Pid.B/2021/PN. Jkt.Cell rev’ewed from the proof of noodweer and noodweer exces. To find and identify the qualifications of noodweer and noodweer exces relating to the criminal act of murder it is necessary to look at positive law, doctrine, and legal interpretation and analyze the judge’s consideration in Judgment Number: 867/Pid.B/2021/PN. Jkt.Cells related proof of noodweer and noodweer exces. Noodweer’s qualifications relate to the criminal offence of murder i.e. there is a sudden unlawful attack or threat on the body, honor or decency, property on oneself or another person and the defence is given in balance with the attack that comes. Meanwhile, the noodweer exces qualification relates to the criminal act of murder, namely that the defense is carried out by going beyond the boundaries because an attack or threat that comes suddenly results in such a violent mental shock. A great mental shock to the murderer is a state of anger or soul that is angry, agitated, afraid, anxious and unsettled. The judge’s consideration that the Defendant was given justification reasons for the noodweer was inconsistent with the facts at tria. Meanwhile, the judge’s consideration that the Defendant was given forgiving reasons for noodweer exces was appropriate and qualified for noodweer exces. Keywords : Noodweer, Noodweer Exces, Murder
