Abstract
The flash sale strategy is a strategy that is currently being used by e-commerce businesses practitioners to attract the attention of consumers, the implementation of the flash sale promotion strategy uses a pricing method for a product below the average market price with a time limit and the products given to attract consumers to get to know the e-commerce business actor's shop better. Determination and impact of the flash sale strategy are felt to undermine the fairness of e-commerce business actors who will enter the market but only have small capital. The existence of a flash sale strategy used by e-commerce business actors has related to predatory pricing actions contained in article 20 of Law number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. An interesting thing to do research on this issue is whether in Indonesia's business competition law the flash sale strategy includes acts of predatory pricing and what is implicit you ridis the flash sale strategy by e-commerce businesses. the whole is contradictory. It is necessary to prove using the rule of reason approach and tests that can be used to find out whether a business actor is engaging in predatory pricing practices or not. If an e-commerce business actor is proven to have committed a predatory pricing practice, he will be subject to administrative sanctions in Article 6 paragraph (2) point C, F and G PP Number 44 of 2021.
