Abstract

The rapid advancement of information technology has created an instant lifestyle for people to enjoy movies without having to go to the cinema, namely by easily accessing movie streaming sites on official websites on the internet such as Netflix. This convenience can also lead to violations such as piracy of film copyrights and selling Netflix accounts illegally through other Over The Top Services. This study raises two problem formulations, namely how is the legal protection of film copyrights on the Netflix application? and What are the legal remedies for infringement of film copyrights on the Netflix application?. This study uses normative research methods with statutory and conceptual approaches. There are 2 (two) forms of legal protection for film copyrights in the Netflix application, namely the form of internal legal protection and the form of external legal protection. In the form of internal legal protection provided by the Netflix application, the parties protect themselves in the contents of the agreement or the clauses of the agreement. Meanwhile, in the form of external legal protection, namely the protection provided by the government in the form of regulations. The legal remedies provided by the government in the event of a violation of a film copyright are non-litigation legal remedies in the form of mediation, negotiation, conciliation, as well as efforts to submit a report to the Directorate General of Intellectual Property in accordance with the PBM for Closing Content and Access Rights. When there is a copyright infringement on the Netflix application, Netflix uses a non-litigation dispute resolution option, namely arbitration. If the nonlitigation legal remedies are not successful, litigation legal remedies can be taken through criminal or civil channels by filing a claim for compensation to the commercial court.
