Abstract

Pelanggaran lalu lintas merupakan suatu permasalahan yang kerap kali terjadi dan mampu membahayakan keselamatan para pengguna jalan lainnya. Seiring dengan kemajuan teknologi, penggunaan pesepeda juga ikut meningkat. Hal ini menjadi pemicu terjadinya pelanggaran - pelanggaran yang dilakukan oleh para pengguna sepeda di jalur jalan raya. Peningkatan pengguna sepeda yang masih belum diiringi dengan rasa kesadaran dan keselamatan dalam berkendara dan sering kali justru mengabaikan peraturan lalu lintas yang telah ditetapkan. Kurangnya rasa kedisiplinan juga menyebabkan para pengguna menjadi acuh terhadap peraturan tersebut, hal ini dapat menyebabkan terjadinya kecelakaan lalu lintas bagi sesama pengguna jalan. Pesepeda yang tidak menaati aturan lalu lintas dikarenakan tidak mempunyai aturan yang mengatur tentang pelanggaran yang dilakukan. Berdasarkan penjelasan tersebut, Penelitian ini merupakan peneitian normatif, yang bertujuan untuk mengetahui sanksi yang tepat bagi pengendara pengguna sepeda agar mampu menaati peraturan lalu lintas yang berlaku berdasarkan undang-undang dan bagaimana undang-undang tersebut dapat diterapkan di kehidupan masyarakat. Diperlukan sebuah aturan karena terdapat sebuah kekosongan hukum, peraturan berupa pidana denda atau pidana kurungan sesuai dengan jenis pelanggaran yang dibuat, hal ini yang diharapkan agar peraturan ini diberlakukan dan menjadi efektif bagi para sesama pengguna jalan.
