Abstract

Hak Milik Atas Tanah hanya dapat dimiliki oleh Warga Negara Indonesia. Hal ini sesuai dengan Asas Nasionalitas bahwa hanya bangsa Indonesia yang dapat memiliki hubungan dengan bumi, air dan kekayaan alam yang terkandung didalamnya. Batas waktu bagi orang asing untuk melepaskan hak milik ini yang diperoleh karena pewarisan belum memberikan kepastian hukum . Penelitian ini menggunakan metode penilitian Normatif dengan menjelaskan dan menjabarkan bersumber dari ketentuan hukum yang telah ada. Bahan hukum primer yang digunakan berupa peraturan perundang-undangan dan bahan hukum sekunder berupa buku-buku teks hukum, pendapat-pendapat para sarjana, artikel- artikel yang ada kaitannya dengan permasalahan yang dibahas, serta kamus hukum. Diperoleh suatu kesimpulan bahwa Asas Nasionalitas berlaku terhadap kepemilikan hak milik atas tanah yang diperoleh karena pewarisan bagi Warga Negara Indonesia yang kehilangan kewarganegaraanya . Batas waktu 1 tahun sejak diperolehnya karena pewarisan untuk melepaskan haknya dimulai sejak hak milik tersebut didaftarkan peralihan haknya pada Kantor Pertanahan setempat lebih memberikan kepastian hukum serta memenuhi asas publisitas
