Abstract

Dalam menjalankan pemerintahan daerah tidak dipungkuri akan terjadi suatu hal yang membuat kekosongan jabatan, dalam hal ini banyak juga wakil kepala daerah yang berhenti sebelum masa jabatannya habis, seperti mengundurkan diri, meninggal akibat penyakit yang sudah lama diderita, dan juga ada yang jabatannya dihentikan. Dalam Undang – Undang Nomor 10 Tahun 2016 Tentang perubahan kedua atas Undang – Undang Nomor 10 Tahun 2015 Tentang Penetapan Peraturan Pemerintah Pengganti Undang – Undang Nomor 1 Tahun 2014 Tentang Pemilihan Gubernur, Bupati dan Walikota Menjadi Undang – Undang, tepatnya dalam ketentuan pasal 176 ayat (4) yang menghendaki untuk dilakukannya pengisan kekosongan jabatan wakil kepala daerah yang masih memiliki sisa jabatan selama 18 (delapan belas) bulan lebih. Ketiadaan suatu norma Hukum yang membatasi waktu maksimal pengisian kekosongan jabatan wakil kepala daerah, menjadi sebuah faktor mengapa tidak dilakukannya pengisian kembali jabatan wakil kepala daerah di Indonesia.
