Abstract
Indonesian citizens have the right to own land rights. However, for Indonesian citizens who carry out mixed marriages, there are exceptions, namely that an agreement on the separation of assets must be made. So that in this study examines the legal position of land rights in mixed marriages and how land rights from mixed marriages can have the status of property rights. This research is a normative juridical research using 3 (three) approach methods, namely statutory approach, conceptual approach, and case approach. And the results of the study show that if based on the Marriage Law and the Basic Agrarian Law, the status of land ownershiprights for Indonesian citizens is the same as fortheirforeign partners. Thisis because Article 35 of Law Number 1 of 1974 concerning Marriage states that property acquired during marriage becomes joint property. However, if Indonesian citizens want to continue to have rights to land with the status of ownership rights, then a marriage agreement for the separation of assets can be made with the aim that what is acquired and owned by the husband or wife remains in the control of each, as stated in Article 29 of the Law -Marriage Act.
