Abstract

ABSTRAK Skripsi ini bertujuan untuk memecahkan permasalahan penelitian force majeure dalam usaha jasa konstruksi yang terdampak pandemi corona virus disease 2019 (COVID-19). Secara khusus, skripsi ini mencoba mendalami penerapan pasal 47 ayat (1) huruf j Undang-Undang Nomor 2 Tahun 2017 tentang Jasa Konstruksi yang mengatur mengenai keadaan memaksa dalam penerapannya pada usaha jasa konstruksi yang terdampak penyebaran pandemi corona virus disease 2019 (COVID-19). Dalam pasal a quo tidak dijelaskan secara mendalam entuk-bentuk apa saja suatu usaha jasa konstruksi dapat dinyatakan mengalami force majeure, sehingga penerapan pasal ini dalam suatu kasus sering memunculkan ketidakpastian hukum. Pembahasan ini merupakan hal penting yang karena penyebaran pandemi COVID-19 bagi usaha jasa konstruksi telah menimbulkan perdebatan mengenai relevansi penerapan keadaan memaksa bagi usaha jasa konstruksi yang mengalami hambatan dalam menyelesaikan kegiatan usahanya. Penelitian ini merupakan penelitian yuridis normatif melalui pendekatan perundang-undangan (statue approach) dan pendekatan kasus (case approach). Selain itu, penelitian ini menggunakan metode pengumpulan data berupa studi pustaka. Melalui studi pustaka ini peneliti mengumpulkan dokumen dan data untuk diolah menggunakan metode analisis ini. Hasil penelitian menunjukkan bahwa penerapan force majeure pada usaha jasa konstruksi yang terdampak pandemi COVID-19 adalah hal yang relevan untuk diterapkan. Hal ini sesuai dengan klasifikasi pembagian force majeure dalam beberapa bidang tertentu, seperti relatif, subjektif, temporer, khusus, dan eksklusif. Selain itu, terdapat akibat hukum penerapan force majeure dalam usaha jasa konstruksi, yaitu penghentian sementara kontrak, renegosiasi, dan pemberian kompensasi kepada buruh dalam usaha jasa konstruksi tersebut.
