Abstract

Protection of Consumers Who Have Lost Due to Buying and Selling Gold Through ITE, How is the Seller's Responsibility in the Case of Default. The type of research that the author uses is "juridical normative", according to Soerjono Soekanto, namely legal research by researching (Soerjono Soekanto 2011) library materials or secondary data as the basic material to be researched by conducting a search on regulations and related literature. with the problem under study. The conclusions and suggestions can be given so that legal protection for consumers in digital buying and selling transactions can be protected. Legal protection of consumer rights in online transactions The term "consumer" relates to legal protection. Therefore, consumer protection contains a legal aspect. The material that gets protection is not just physical, but moreover abstract rights. In other words Consumer protection is actually identical to the protection provided by law on consumer rights. Consumer protection is identical to the protection provided by law on consumer rights. In general, there are 4 (four) basic rights of consumers, namely: • The Right to Safety • Right to be Informed • The Right to Choose • The Right to be Heard Law Number 8 of 1999 concerning Consumer Protection (UUPK) has not been able to protect consumers in online buying and selling transactions because this UUPK has a limited understanding of business actors where it is stated that the business actors mentioned in this UUPK are business actors whose jurisdiction is in the territory of the Republic of Indonesia. Republic of Indonesia. UUPK does not specifically regulate the crime of fraud in online buying and selling. So far, the crime of fraud is regulated in Article 378 of the Criminal Code ("KUHP"). Whereas online buying and selling transactions are a trading model that can cross the jurisdiction of a country. So if there is a dispute that harms consumers in Indonesia, this UUPK cannot reach it. In addition, the consumer xii rights regulated in the UUPK are limited to conventional transactions only. although UUPK has limitations in protecting consumers, it can still reach online shop business actors in the territory of the Republic of Indonesia. 1. The government should immediately make legislation on consumer protection that regulates legal protection for consumers in digital gold buying and selling transactions because later it will become a reality, so that the government should not be left behind in its legal instruments. 2. Investors should be aware of their rights as consumers in buying and selling digital gold. And business actors should act honestly in running ecommerce stalls.
