Abstract
Kompilasi Hukum Islam merupakan kumpulan atau himpunan kaidah-kaidah, norma-norma hukum islam yang bersumber dari beberapa kitab-kitab fiqh empat mazhab terdiri dari mazhab syafi’i, mazhab maliki, mazhab hanafi, mazhab hambali yang kemudian oleh para ulama-ulama maupun cendikiawan dibukukan dengan menggunakan bahasa hukum atau bahasa perundang-undangan. Instruksi Presiden Nomor 1 Tahun 1991 sebagai landasan hukum keberadaan Kompilasi Hukum Islam, namun dalam perkembangan sistem perundang-undangan dan sistem ketatanegaraan kedudukan instruksi presiden tidak dikenal dan tidak memiliki kekuatan mengikat. Dengan demikian, Kompilasi Hukum Islam ini agar dapat menjadi hukum positif di Indonesia yang secara sah dan memiliki kekuatan mengikat yaitu dengan meningkatkan kedudukan produk hukum Instruksi Presiden No. Tahun 1991 menjadi Peraturan Pemerintah Pengganti Undang-Undang atau Presiden dapat mengajukan rancangan undang-undang kepada DPR agar dapat disetujui bersama menjadi Undang-Undang. Kata Kunci : Inpres 1/1991, Kompilasi Hukum Islam, Kedudukan Perundang-undangan (The Compilation of Islamic Law is a collection or set of rules, norms of Islamic law originating from several fiqh books of four schools consisting of the Shafi'i school, the Maliki school, the Hanafi school, the Slavi school which was later carried out by scholars and scholars. recorded using the language of law or the language of legislation. Presidential Instruction No. 1/1991 as the legal basis for the existence of the Islamic Law Compilation, however, in the development of the statutory system and constitutional system, the position of the presidential instruction is unknown and has no binding force. Thus, the Compilation of Islamic Law in order to become a positive law in Indonesia which is legally binding and has binding power, namely by increasing the position of the legal product of Presidential Instruction No. In 1991 it became a Government Regulation in Lieu of Law or the President may submit a draft law to the DPR so that it can be jointly approved as a Law.
