Abstract

The title of this research is the responsibility of the e-commerce provider to the user's personal data. This study focuses on the form of responsibility of the e-commerce provider to the user's personal data and the sanctions against the e-commerce provider if it fails to protect the user's personal data. The purpose of this study is to determine the form of responsibility of the ecommerce provider to the user's personal data and to find out the sanctions that can be given to the e-commerce provider if it fails to protect the user's personal data based on the legal basis in force in Indonesia. This research is a normative research with a statutory approach and a conceptual approach. The findings of this study are the obligations of the e-commerce provider, namely being responsible for personal data that has been collected and processed and if the personal data that has been processed and collected is leaked then the e-commerce organizer will be subject to criminal, civil, and administrative sanctions according to legislation. applicable invitation. The conclusion of the research has shown that although there is no legislation specifically regulating the protection of personal data, Article 28G paragraph (1) of the 1945 Constitution of the Republic of Indonesia, Article 1 number 22 of Law Number 24 of 2013 concerning Amendments to Law Number 23 of 2006 concerning Population Administration and Article 15 paragraph (1) of Government Regulation Number 82 of 2012 Implementation of Electronic Systems and Transactions has provided an explanation that personal data is a person's privacy which must be protected for security so that if data leaks occur due to operator error e-commerce then it is an act against the law.
