Abstract

Penelitian hukum ini bertujuan untuk mengetahui pengaturan tentang praktik tukang gigi dalam pelayanan kesehatan serta untuk mengetahui perlindungan hukum terhadap pengguna jasa tukang gigi dalam praktik tukang gigi. Penelitian ini dilakukan menggunakan metode penelitian hukum normatif. Pendekatan penelitian dengan pendekatan undang-undang (statute approach) dan pendekatan konseptual (conceptual approach). Berdasarkan penelitian ini diperoleh hasil bahwa pengaturan tentang praktik tukang gigi merujuk pada Peraturan Menteri Kesehatan No. 39 Tahun 2014 tentang Pembinaan, Pengawasan, Perizinan dan Pekerjaan Tukang Gigi yang dikeluarkan berdasarkan Putusan Mahkamah Konstitusi Nomor 40/PUU-X/2012 yang merupakan putusan Judicial Review. Aturan ini belum memberikan perlindungan hukum bagi pengguna jasa tukang gigi yang mengalami malpraktik. Pelanggaran yang dilakukan oleh tukang gigi dalam melaksanakan pekerjaannya menimbulkan adanya korban yang mengalami kerugian. Implikasi hukum dari tidak adanya aturan hukum positif yang lengkap dan berkepastian hukum dari pemerintah merupakan peluang tukang gigi melakukan praktik atau tindakan melebihi kewenangannya, yang berakibat munculnya dugaan malpraktik, yang menimbulkan kerugian bagi konsumen yang melakukan perawatan gigi pada tukang gigi tersebut. Perlindungan hukum seharusnya dapat diberikan melalui undang-undang baru tentang praktik tukang gigi yang memuat kewenangan tukang gigi sehingga terdapat batas kewenangan tukang gigi yang berbeda dengan dokter gigi. Bagi tukang gigi yang melakukan praktik seolah-olah seperti dokter gigi maka telah melanggar Pasal 78 Nomor 29 Tahun 2004 tentang Praktik Kedokteran dengan sanksi pidana. Kata Kunci: Tukang Gigi, Praktik, Pengguna Jasa, Perlindungan Hukum (This legal research aims to determine the regulation of the practice of dental artisans in health services as well as to determine the legal protection of dental artisans in dental practice. This research was conducted using normative legal research methods. The research approach uses a statute approach and a conceptual approach. Based on this research, it was found that the regulation regarding dental practice refers to the Regulation of the Minister of Health no. 39 of 2014 concerning the Guidance, Supervision, Licensing and Employment of Dentists issued based on the Constitutional Court Decision Number 40/PUU-X/2012 which is a Judicial Review decision. This rule does not provide legal protection for dental artisans who experience malpractice. Violations committed by dental artisans in carrying out their work cause victims to suffer losses. The legal implication of the absence of complete positive legal regulations and legal certainty from the government is an opportunity for dental artisans to practice or act beyond their authority, which results in the emergence of allegations of malpractice, which causes harm to consumers who perform dental treatment on the dental artisan. Legal protection should be provided through a new law on the practice of dental artisans which contains the authority of dental artisans so that there is a limit to the authority of dental artisans who are different from dentists. For dental artisans who practice as if they were dentists, they have violated Article 78 Number 29 of 2004 concerning Medical Practices with criminal sanctions.
