Abstract

The study entitled "Buyer Legal Protection for Cancellation of Land Sale and Purchase Deeds and Land Title Certificates (Study of Pontianak District Court Decision Number 127/PDT.G/2019/PN.Ptk)", is based on the cancellation of land rights certificates based on District Court decisions , making the buyer disadvantaged. Issues discussed: What are the legal consequences for the cancellation of the deed of transfer of land rights made before the Land Deed Making Officer against the transfer of the name of the certificate and How is the legal protection for the buyer for the cancellation of the deed of sale and purchase and the certificate of land rights that have been transferred. Research using a normative approach, it is concluded that: The legal consequences of the cancellation of the deed of transfer of land rights made before the PPAT against the transfer of the name of the certificate, even though the sale and purchase has been made according to the correct procedure, which is evidenced by the deed of transfer of rights made before the PPAT Article 37 paragraph (1) PP No. 24 of 1997 and has been rebranded Article 39 of PP No. 24 of 1997, the deed is canceled based on the decision of the District Court, deed of sale and purchase and certificate as evidence of the buyer having bad intentions. Legal protection for buyers for the cancellation of the deed of sale and purchase and certificates of land rights that have been renamed, that even though the buyer has bad intentions based on the court judge's decision, as long as he can prove the cancellation of the deed and certificate as long as he can prove the buyer was harmed, he can sue for compensation. Claims for compensation through civil lawsuits on the basis of unlawful acts with reimbursement of costs, losses and interest Article 1365 in conjunction with Article 1246 of the Civil Code.
