Abstract

The rate of copyright piracy of music and songs in some countries in Indonesia high numbers. The Indonesian community prefers to choose genuine music and pirated songs, arguing the high cost of original work and the price difference. Juridically, the crux of the violation of the copyright of this music and song is contrary to article 2 point (1) of the Berne Convention for the Protection of Literary and Artistic Works which contains music is a nationally protected and translated creation under paragraph 12 (1) Law of the Republic of Indonesia Number 28 Year 2014 regarding Copyright. Therefore, real action is required from. The author wants to discuss about the ideal law enforcement concept against the case of copyright infringement of music and songs digitally and the dominant factors affecting copyright (piracy) copyrighted music and songs in Indonesia. The research method used is normative juridical, by detailing the literature materials. Based on the results of the research that the authors do, it can be concluded, the ideal law enforcement concept against the case of copyright of music and song copyright is the role of the government in the enforcement of copyright law should be further enhanced by way of efforts such as pre-emtive efforts, Preventive, and repressive. The government must give a firm vote of seizure and destruction of the proceeds of Violations (piracy), exemptions regulated by Copyright Act No. 28 of 2014. Factors affecting Violations (piracy) of music and songs are more dominant by economic factors, Affordable for society, Technological factors, Law Enforcement factors and low public awareness of illegal pirated goods.
