Abstract

This article titled Legal Protection of Workers with Disabilities Under Law No. 13 of 2003 concerning Employment. Legal Protection of general labor in the material contained in the Constitution of the Republic of Indonesia in 1945 Article 27, paragraph 2, and in Article 67 paragraph 1 and 2 contained in Law No. 13 of 2003 concerning Employment. Every citizen has the right to work and to a decent living, but in practice there are violations committed by the company. But in implementation, business / employers seemed reluctant in hiring workers with disabilities and choose employ with normal condition. This article aims to determine the legal protection that should be given to workers with disabilities are also remedies do workers with disabilities on their rights being violated. The method used is a normative legal research is approach to reviewing the legislation applicable. The conclusion of this paper is that workers with disabilities before work got the protection of the rules of law as well as employment of persons with disabilities at work get legal protection from social security employment. Legal remedies that can be done is by bipartite, mediation, conciliation, and arbitration. To avoid violations of the right of persons with disabilities, the government especially the legislature makes laws and regulations and establish institutions that fully protect and uphold the rights of workers with disabilities.
