Abstract

Dalam perjanjian dikenal Asas Pacta Sunt Servanda yang berarti perjanjian yang dibuat secara sah berlaku sebagai undang-undang bagi mereka yang membuatnya. Oleh sebab itu, para pihak harus tunduk dengan syarat, hak, dan kewajiban kerja dalam suatu perjanjian. Dengan adanya aturan tersebut memicu beberapa persoalan yang bertentangan dengan masalah pribadi seseorang, terutama pekerja. Hak pekerja untuk memenuhi kebutuhan membentuk keluarga tidak terakomodir secara baik, hal itu dikarenakan peraturan dari beberapa perusahaan yang bermaksud agar pekerjanya fokus untuk memajukan perusahaan, sehingga mengharuskan pekerjanya untuk menunda atau bersedia tidak menikah selama perjanjian kerja berlangsung. Akan tetapi, aturan menikah jika dilihat dari perspektif HAM adalah sebuah hak yang mengartikan menikah adalah pilihan. Menikah termasuk hak yang tergantung dari kebutuhan dan keinginan manusia itu sendiri. Oleh sebab itu, dalam praktiknya pada kehidupan sehari-hari kedua hal tersebut seringkali menimbulkan perbedaan pendapat yang cukup krusial sehingga solusi dalam penyelesaiannya pun juga kerap menimbulkan perbedaan. Dengan demikian, perlu adanya segala aturan hukum yang sesuai dengan peraturan perundang-undangan untuk menjamin hak dari para pihak. Penelitian ini termasuk dalam penelitian yuridis normatif. Bahan-bahan penelitian yang digunakan dalam penelitian ini adalah data sekunder, yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Bahan hukum primer berupa peraturan perundang-undangan, sedangkan bahan hukum sekunder, yaitu jurnal, buku dan makalah.
