Abstract

Materi pokok penelitian tinjauan yuridis tentang pelelangan terhadap debitur yang beritikad baik oleh kreditur dalam jaminan fidusia. Dalam perkembangan masa kini begitu besar antusias masyarakat untuk terus melakukan kemajuan dalam melaksanakan kegiatan guna menghasilkan pendapatan yang lebih, dalam hal perkembangan ekonomi. Sebagai penopang kebutuhan masyarakat, perkembangan, ekonomi, dan perkembangan perkreditan dalam kehidupan masyarakat di Indonesia saat ini memerlukan bentuk jaminan-jaminan pembiayaan. Fidusia merupakan hak kebendaan bersifat memberikan suatu jaminan. Objeknya adalah benda bergerak berwujud, tidak berwujud dan benda tidak bergerak yang tidak dapat dijamin dengan menggunakan hak tanggungan. Debitur yang melakukan wanprestasi, pihak kreditur melakukan eksekusi objek fidusia secara sepihak, hal ini dapat dikatakan bertentangan dengan UUD Tahun 1945. Pasal 15 ayat (2) dan pasal 15 ayat (3) UU Nomor 42 Tahun 1999 tentang jaminan fidusia. Rumusan masalah, Apakah tindakan melelang secara sepihak yang dilakukan oleh pihak kreditur sebagai penerima fidusia merupakan wanprestasi jika debitur telah beritikad baik untuk pelunasan hutang. Penelitian secara yuridis normatif, Metode menggunakan penelitian kualitatif dengan pendekatan normatif. Pembahasan mencakup kedudukan debitur dan kreditur, serta mencakup eksekusi yang digunakan sebelum keluarnya Mahkamah Konstitusi No. 18/PUU-XVII/2019. Dan setelah keluarnya putusan Mahkamah Konstitusi No. 18 /PUUXVII/2019 yang berisikan bahwa Pasal 15 ayat (2) dan Pasal 15 ayat (3) UU Nomor 42 Tahun 1999 tentang Jaminan Fidusia bersifat bertentangan dengan UUD Tahun 1945.
