Abstract

Pawning in its implementation is carried out by the pawnshop institution. The definition of pawnshop is a non-bank financial institution that provides credit to the public. This pawn explanation is regulated in Article 1150 of the Civil Code to Article 1161 of the Civil Code, and institutionally regulated in Government Regulation No. 103 of 2000 concerning Pawnshops. The rights obtained from those who lend money or pawnshops are monthly installments and loan interest at an agreed time and if the borrower experiences problems, the borrower has the right to sell his collateral. And vice versa the rights of the lender, namely the receipt of money from the guarantee. Both parties have a legal relationship that is bound in the pawn. What is the form of responsibility and form of compensation given by the creditor to the debtor for the object of the pawn being lost if the pawned item is lost in the hands of the creditor. The research used is normative juridical research, approach method of law approach, conceptual approach. in the provisions of Article 13 paragraph (3) of the Basic Rules of Pawnshops Jo Article 6 paragraph (4) of the Pawnshop Work Order Book. Regarding the amount of compensation to PT. Pegadaian (Persero) has been set at 125% (percent) of the estimated price.
