Abstract

Ukuran suatu perbuatan yang dapat disebut pencemaran nama baik masih belum jelas karena banyaknya faktor yang harus dipelajari. Hukum dituntut benar-benar bersifat normatif, dalam arti kata menyelesaikan perkara pidana harus berdasarkan peraturan perundang- undangan yang ada. Berbeda halnya dengan bidang hukum perdata atau bidang hukum lainnya, hukum pidana memiliki asas legalitas yang menekankan bahwa suatu perbuatan hanya dapat dipidana jika ada aturan hukum tertulis yang mengaturnya sebelum perbuatan itu dilakukan. Hak atas kebebasan berekspresi merupakan hak asasi manusia yang fundamental yang dijamin dan memiliki arti yang esensial. Namun diakui pula bahwa kebebasan berekspresi bukanlah hak yang mutlak dan dapat dibatasi, terutama dalam penggunaan media sosial yang perkembangan penggunaannya sangat pesat. Permasalahan yang terjadi pada contoh kasus yang penulis bahas adalah Perlindungan Hukum Hak Kebebasan Berekspresi Warganet dalam Kasus Pencemaran Nama Baik Pasal 27 ayat (3) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Termasuk bagaimana hukum hak asasi manusia dalam hukum internasional yang memandang kasus ini. Batasan-batasan yang telah diatur oleh hukum hak asasi manusia internasional di ICCPR, belum memenuhi ketentuan dalam Undang-Undang Nomor 19 Tahun 2016 di Indonesia. Pelaksanaan hak atas kebebasan berekspresi, tanpa rasa takut atau campur tangan, sangat penting untuk eksis dalam masyarakat demokratis, di mana setiap orang memiliki akses untuk menikmati hak asasi manusia. Sayangnya, pemerintah di berbagai negara di dunia seringkali memenjarakan orang karena pelaksanaan hak atas kebebasan berekspresi. Pemerintah seringkali melarang penyampaian ujaran kebencian, tetapi juga ditemukan telah menyalahgunakan wewenangnya untuk membungkam keragaman pendapat warganya, dan mengeluarkan peraturan perundang-undangan yang mengriminalisasi kebebasan berekspresi belakangan ini. Kebebasan berekspresi berada dalam krisis karena perlindungannya terancam oleh otoritas represif terhadap aktivis dan individu.
