Abstract

Radikalisme merupakan sebuah masalah yang serius di berbagai negara. Adanya fenomena radikalisme yang terjadi terus menerus di Indonesia hingga pada saat ini menjadi point penting yang mana ancaman mengenai paham radikalisme dan terorisme itu ada di sekitar masyarakat, berkaitan dengan maraknya aksi terorisme yang terhitung hingga saat ini sudah terjadi 10 aksi terorisme. Dalam menangani kasus tersebut aparat kepolisian menggunakan tindakan represif, tindakan ini dilakukan oleh aparat kepolisian dengan melakukan aksi pembunuhan diluar pengadilan (tembak mati di tempat) atau extrajudicial killing. Dari problematika tersebut, terdapat dua rumusan masalah yaitu yang pertama mengenai apakah tindakan polisi dalam menggunakan tindakan represif terhadap perkara tindak pidana terorisme ini telah sesuai dengan perspektif HAM dan bagaimana batas kewenangan polisi dalam penggunaan tindakan represif terhadap perkara tindak pidana terorisme. Rumusan tersebut diselesaikan dengan menggunakan metode yuridis normatif dengan pendekatan perundang – undangan, dan pendekatan konseptual. Hasil penelitian ini dapat menggali lebih dalam mengenai tindakan polisi dalam penggunaan tindakan represif terhadap perkara tindak pidana terorisme ini apakah telah sesuai dengan perspektif HAM, dan mengenai bagaimana batas kewenangan dari aparat kepolisian dalam penggunaan tindakan represif terhadap perkara tindak pidana terorisme, apabila terjadi ketidaksesuaian maka dapat memberikan masukan kepada DPR untuk melakukan pengkajian dan perbaikan Undang – Undang.
