Abstract

Marriage is something that is very important and eagerly awaited by every human being as a new step in life. Underage marriage is an integral part of human rights. Minister of Religion Regulation No. 11 of 2007 concerning the registration of marriage article 8 explains that if a prospective husband has not reached the age of 19 years and a prospective wife has not reached the age of 16, she must receive a dispensation from the court. The polemic occurred when the Constitutional Court granted a judicial review lawsuit filed against Law Number 1 of 1974 concerning marriage. then develop because it changes in contrast to previous decisions. Meanwhile the purpose of this study is to find out the juridical review of Law Number 1 of 1974 concerning marriage to the Judicial Review decision of the Constitutional Court Number 22 / PUU - XV / 2017 recognizing the age limit of marriage and knowing legal protection for children who do underage marriage according to the decision of the Constitutional Court Number 22 / PUU - XV / 2017. The Constitutional Court stated in its ruling that a regulation that allows 16-year-old women to marry violates the 1945 Constitution.
