Abstract

Diversion as part of Juvenile Justice System based on handling criminal cases with a restorative ustice approach. In the case resolution process through the restorative justice approach, an action taken in considered fair because the action involves all component. All components in the special criminal justice system, all dliberations seek agreement to determine the best course of action for a child who commits a criminal offense. In writing dissertation handling children in conflict with the law through diversion, the author uses a normative research that is combined with historical approach and conceptual approach. Normative research is carried out by reviewing laws and books on diversion and the juvenile system. The historical approach is carried out by examining the process of the juvenile system and the formation of diversion in Indonesia law, while the conceptual approach is carried out by examining the diversion in Indonesia law and its role child protection. From the results of this study, diversion was carried out on the based of Law no. 11 of 2012 Concerning The Juvenile Justice System. The diversion is carried out strating from the level of investigators, public prosescutors to the court. Diversion is still limited to crimes with victims and the threat of punishment under 7 (seven) years. Diversion is carried out as an alternative so that children do not enter the justice process and return to its original state. Keywords: Diversion, Juvenile Justice System, Restorative Justice
