Abstract

Liability principles the tort actor of copy right is not stipulated at the copyright law, so in this regard different from liability principles in general civil law as stipulated liability principle based on fault. The problem formulations in this writing as followes: The liability principle of the tort actor of economy rights in copy rights. This research uses the normative legal research methods comprising of status approach, case approach, conceptual approach, historical approach, comparative approach, analatycal and philosophical approach. Principle of liabilty of the tort actor are as follows: a. The liability principle of the tort Actor of economy rights in copyrights is not stipulated at the copyright law, so in this regard there is vacuum of norms. b. The liability principle of the tort actor of economy rights in copyrights throught the legal invention, in this regard is based on the grammatical interpretations that the principle of economy rights is absolute liability and compensation liability. Moral Rights is liability based on fault as dolus. The cancellations is absolute liability and eliminations is absolute liability.
