Abstract

The double track system is a two-track system regarding sanctions in criminal law, namely types of criminal sanctions from one party and types of sanctions for actions on the other. In the double track system, the formulation of sanctions against narcotics abuse is a criminal law policy in the formulation of provisions governing the sanctions given to narcotics abuse offenders, namely in the form of criminal sanctions and sanctions considering the perpetrators of narcotics abuse have a slightly different position from other criminal offenders.On the one hand, narcotics users are perpetrators of criminal acts who must be punished, but on the other hand, they are victims of criminal acts they have committed themselves, so it is necessary to carry out an action in the form of rehabilitation. Therefore, the authors take the formulation of the problem, among others, How is the Decidendi Ratio against narcotics abuse perpetrators and what is the criminal law policy in the future against narcotics abuse offenders. In research for writing this thesis, the author will use a type of normative research. This research is conducted or aimed at written regulations and other legal materials. For legal research that is normative in nature, the author will use the type of normative research, which is a study focused on examining positive legal research, in this case, written legal materials. Reformulation of the definition of victims of narcotics abuse needs to be carried out with the concept of depenalization. The concept is that the criminal law policy in the future will include narcotics abusers themselves as victims who are obliged to undergo medical and social rehabilitation, not criminal law.
