Abstract

Paper satellite issue surfaced after the implementation of “first comes first served” principle. An appeal to replace the principle with an allotment plan has been proposed by developing country in hopes that the plan could accommodate states to secure a GSO orbit slot, which functions as a nation’s asset to assist the development of telecommunication and broadcasting technology. In addition to the plan, it is also needed to implement a clear and firm rule pertaining to unplanned bands, which is originally meant as a way to backup GSO orbit slots, but on the other hand, it allows states to propose an unlimited amount of additional orbit slots. The appeal to use orbital slot by the principle of unplanned band is also seen as an embodiment of will from non-space power states, which are mostly developing nations, to realize equitable rights because there are beliefs that protection of developing nations under ITU is limited, and thus, those nations could easily fall victim to space power states which are more technologically advanced. The solution for the paper satellite dispute which is about the abuse of GSO orbit slot will face challenges in the form of solving mechanism which is different for each state. This occurs because there is no principle value, norms and standardized mechanism pertaining to the solving of the dispute in space law. Therefore, to solve the paper satellite dispute, it is necessary to involve a standardized mechanism which can solve the dispute and can be a guide that follows the norms and principles of space law. This must be strengthened to give clarity in the implementation of unplanned band for GSO utilization. In doing so, the utilization of space will be fairer in fulfilling the needs and interests for human race for both developed and developing nations continuously.
