Abstract

One of the threats to state sovereignty is terrorism. Terrorism can pose a threat to peace and security both the State and the international world. The acts of terror resulted in the loss sense of security within midst of society. This action too resulted in the decline of the authority of the government as an institution that should provide protection and security of its citizens. The implications of the loss sense of security will also have an impact on social and economic development that could harm the welfare of the people. Terrorism is currently classified as one of eight transnational crimes. Indonesia as one of the countries that are still not safe from the action of terror. These acts of terror caused fear and resulted in the loss of life. It is necessary for the issuance of legislation that can regulate terrorism. Through this regulation is expected to create a conducive atmosphere, maintaining order and security without leaving legal principles. And able to provide protection against the sovereignty of the state, the protection of the human rights of witnesses and victims and then suspects or defendants. In this study aims to analyze Intelligence reports as an effort in tackling terrorism crimes and analyze intelligence reports as sufficient proof of beginning in efforts to counter terrorism penalties. This study uses normative legal methods and several problem approaches, theoretical basis and explanation of concepts that will address legal issues. Based on the results of research indicates that the use of intelligence report as a non penal effort in tackling terrorism crime in accordance with the role and function of state intelligence. However, consideration in making decisions on terrorism becomes the authority and assessment of the investigator. This research proposes a legal penalty protection effort to the public by establishing the intelligence report used as a preliminary proof of having to be A1 degree and containing a limitative proof.
