Abstract

Perkembangan media sosial telah mengubah pola komunikasi masyarakat dan meningkatkan potensi terjadinya pencemaran nama baik di ruang digital. Salah satu persoalan hukum yang muncul adalah penyebaran ulang konten bermuatan pencemaran nama baik oleh pengguna media sosial yang bukan merupakan pembuat awal konten. Penyebaran ulang melalui repost, retweet, atau forward dapat memperluas dampak pencemaran serta menimbulkan konsekuensi hukum pidana. Penelitian ini bertujuan untuk menganalisis kedudukan hukum penyebar ulang konten serta pertanggungjawaban pidana yang dapat dikenakan berdasarkan peraturan perundang-undangan yang berlaku. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Pengaturan mengenai pencemaran nama baik di ruang digital diatur dalam Pasal 27 ayat (3) Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagaimana telah diubah terakhir dengan Undang-Undang Nomor 1 Tahun 2024, serta ketentuan pencemaran nama baik dalam Kitab Undang-Undang Hukum Pidana. Hasil penelitian menunjukkan bahwa penyebar ulang konten tidak secara otomatis dapat dimintai pertanggungjawaban pidana, melainkan harus dibuktikan adanya unsur kesengajaan, pengetahuan atas muatan pencemaran, serta peran aktif dalam penyebaran konten tersebut.
