Abstract

The development of digital technology has significantly affected the system of copyright protection for musical works, particularly in relation to the regulation of reproduction for private use as stipulated in Article 46 paragraph (1) of Law Number 28 of 2014 on Copyright. This provision provides an exception to the requirement of obtaining authorization from the author; however, it does not establish clear normative boundaries regarding the meaning of the term “private use.” Such ambiguity has the potential to generate divergent interpretations among the public and law enforcement authorities, while also creating opportunities for misuse that may weaken the protection of authors’ economic rights. This research aims to examine and interpret the meaning of “private use” through grammatical interpretation and comparative analysis with copyright regulations in Japan and Germany, as well as to assess its implications for the protection of the economic rights of songwriters. This study employs normative legal research using statutory, conceptual, case-based, and comparative approaches. The findings indicate that the concept of private use should be interpreted restrictively, limited to individual and private use, non-commercial in nature, and without impact on public interests. Therefore, clearer and more explicit normative boundaries within the Copyright Law are necessary to ensure legal certainty and to provide fair and proportional protection for songwriters’ economic rights.
