Abstract

Penelitian ini mengkaji implikasi hukum Putusan Mahkamah Konstitusi Nomor 135/PUU-XXII/2024 terhadap perubahan desain pemilu nasional dan pemilu lokal di Indonesia. Fokus penelitian diarahkan pada ratio decidendi Mahkamah Konstitusi dalam menetapkan model pemilu dua gelombang serta akibat hukumnya terhadap prinsip kedaulatan rakyat dan penyelenggaraan pemilu. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundangundangan, kasus dan konseptual. Bahan hukum primer dan sekunder dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa putusan tersebut membawa perubahan mendasar terhadap arsitektur pemilu termasuk pemisahan tahapan pemilu dan penyesuaian masa jabatan lembaga perwakilan. Putusan ini juga menuntut pembentuk undang-undang dan penyelenggara pemilu untuk melakukan harmonisasi regulasi agar tidak menimbulkan persoalan legitimasi demokratis.
